Driver and trucking company sued for endangering public safety
The mother of an 18-year-old woman who was killed in a Rogersville, Tennessee truck crash is suing the truck driver and the trucking company, according to Kingsport Times-News. The accident occurred when the truck driver attempted to make an illegal left turn and ended up driving into oncoming traffic. The teenager, whose daughter and boyfriend were also seriously injured in the crash, drove head-on into the truck and later succumbed to her injuries. The lawsuit alleges, among other claims, that the driver endangered public safety by disregarding the rules of the road.
Illegal left turn
While criminal charges are still pending in the case until toxicology test results come through, police say the accident occurred when the driver of a tractor trailer attempted to make a left-hand turn where such a turn was prohibited. The teenage woman's car drove into the truck, resulting in her death and serious injuries for the other two occupants. The truck driver claims that his GPS said that such a turn was possible. He was not injured in the crash.
The lawsuit, which was filed against both the driver and the Michigan-based trucking company, alleges that the driver disregarded signs that were posted prohibiting left turns, according to the Rogersville Review. The lawsuit claims that the driver's negligence resulted in the suffering and later death of the young woman and has left her family liable for her medical expenses. The family is seeking compensation for pain and suffering, medical expenses, and the loss of support the young woman's daughter will now have to endure. The lawsuit was filed in the Greeneville U.S. District Court for the Eastern District of Tennessee on August 10.
Truck accidents, as this case shows, differ significantly from other types of motor vehicle crashes. For one, crashes involving such trucks tend to be very serious since many trucks are significantly larger than most other vehicles on the road. Drivers of smaller vehicles that collide with a large truck often suffer severe injuries or even death.
Furthermore, the fact is that while gathering evidence at the scene of any crash is important, this point is especially true when it comes to accidents involving trucking companies. Victims of such accidents will need to collect evidence at the scene as soon as possible especially since a trucking company may later try to dispute claims made by those victims. In addition to photo evidence, police reports and witness testimony are also crucial, especially when factors involving driver negligence, such as fatigue, may have a significant impact on a personal injury claim.
Hiring a personal injury attorney
Of course, when an accident occurs, the most important thing for victims is to make sure they receive medical attention right away. As such, it is important to consult a personal injury attorney as soon as possible who can take care of any liability issues that may be at stake. In addition to helping gather evidence, an experienced attorney can help make sure victims receive proper medical attention and can also provide compassionate advice when pursuing a personal injury claim.
