If You Were Hurt on the Job, You Have Rights

Each state has it's own rules regarding workers' compensation. The team at Wood & Carlton is thoroughly knowledgeable in the process of applying for benefits and defending claims in Mississippi and Tennessee. It is important to note that some of our clients may have the option of filing in either state, so understanding the differences can be very important. We also regularly work with physicians in both states to help our clients find appropriate medical treatment for their on-the-job injury or work-related illness.

After a serious workplace accident or other disabling occupational injury, you may have the right to receive:

  • Disability Benefits: If your doctor determines that you are unable to work due to your injury, you are entitled to receive two-thirds of your gross average weekly wages, based upon your earnings for the past 52 weeks prior to your injury.
  • Medical Benefits: You are able to receive medical treatment as long as the treating physician deems fit, including providing off-work excuses and permission to return to light duty work.
  • Permanent Disability and Final Settlement: If you attain maximum medical improvement and have not recovered fully, your doctor will assign you an impairment rating. Your permanent disability rating will be based on your impairment rating and a number of other vocational factors. You and the insurance company may agree upon a final settlement.

We can also help injured workers who suffer a permanent disability seek benefits through Social Security. If a work injury causes the death of an employee, workers' compensation disability benefits may be available to the spouse, dependent children and the estate.

Workers' compensation is a highly technical area of law. Not every attorney can offer you the knowledgeable guidance you need. Our law firm is dedicated to helping injured and disabled clients in Mississippi and western Tennessee obtain the benefits and compensation they deserve.
