Understanding the workers' compensation process in Mississippi


Workers' compensation is an important resource for many workers and their families. As such, it is important for workers and families to be familiar with the workers' compensation process and to understand the workers' compensation benefits that may be available in Mississippi.

Workers' compensation is a type of insurance employers carry to protect workers if they suffer an injury on the job or occupation illness. When a worker is injured, it is important to promptly report the injury to the worker's employer. The employer or employer's insurance carrier pay workers' compensation claims. There are different categories of disability that may receive benefits.

One category is temporary total disability. When a worker medically establishes an inability to work because of the injury, workers' compensation benefits are paid out at two-thirds of the worker's average weekly wage. The amount paid is subject to minimum and maximum amounts. There is also a waiting period and time limits may also be associated with the payment of any benefits.

Another category is temporary partial disability. If the worker is temporarily able to return to light duty work, certain benefits based on a portion of difference in earnings may be available. Permanent partial disability may occasion the payment of lost wages, while a worker may be considered to have permanent total disability in circumstances when the injury prevents the worker from performing any job.

Medical expenses are also available to injured workers through the workers' compensation process and workers are permitted to choose their own doctor. Workers may be able to receive medical expenses for the duration of the injury. Benefits are available to surviving family members when a worker dies due to an occupational injury. Funeral expenses and some other payments may be possible as well.

Workers' compensation is an important resource to protect workers and their families when they have been harmed on the job. To better protect themselves, workers may wish to be knowledgeable about the benefits and rights available to them when harmed on the job.
